OUR GENERAL TERMS AND CONDITIONS OF SALE

The Aaron Kali company markets customizable products through a remote sales network via electronic means (Internet).

Article 1: Scope of application

These general conditions of sale are applicable to all sales of customizable products concluded via the merchant site aaronkali.com for delivery in France, Europe and worldwide (subject to conditions).

The customer declares that they have read these general terms and conditions of sale before placing their order. Validation of their order therefore constitutes acceptance without restriction or reservation of these general terms and conditions of sale.

Article 3: Product Information

The information relating to all products that may be sold on the aaronkali.com website complies with the requirements of current legal and regulatory texts, in particular Articles L. 111-1, L. 113-3 and L. 121-18 of the Consumer Code and the ministerial decree of December 3, 1987 "relating to consumer information on prices".

Article 4: Price of products

The price of the products includes all taxes, plus delivery costs.

The price including tax of each product as well as the amount of transport costs relating to their delivery will be communicated to the customer when connecting to the website aaronkali.com.

In accordance with the provisions of Article L.121 19 of the Consumer Code, the customer will receive, upon delivery, for each of the products, written confirmation of the price paid detailing the price of the products and the delivery costs charged to him.

Article 4: Product orders

4.1 Online orders

Orders may be placed online on the merchant website accessible from the French version of the aaronkali.com website. The customer is responsible for telecommunications costs when accessing the Internet and using the aaronkali.com website. The photographs, graphics and descriptions of the products offered for sale are for informational purposes only and do not bind aaronkali.com in any way.

In the event of a manifest error between the characteristics of the products and their representation, the company Aaron Kali cannot be held liable.

In order to purchase a product for their first order, the customer must open a customer account and complete an order form specifying certain mandatory fields so that their selection can be taken into account by the Aaron Kali company.

In the event of prolonged inactivity while logging in, it is possible that the selection of products chosen prior to this inactivity may no longer be guaranteed. The customer will be prompted to restart their product selection from the beginning.

All steps necessary for the sale will be specified on the website aaronkali.com in accordance with the provisions of article 1369-1 of the Civil Code.

In accordance with the provisions of Article 1369-2 of the Civil Code, the customer will have the opportunity, before definitively confirming his order, to check the details of his order and its total price, and to correct any errors, before confirming it to express his acceptance. From the moment the customer has validated his order, the company Aaron Kali will acknowledge receipt of it without delay and electronically.

4.2 Order payment:

Payment for customer purchases is made by credit card only. The customer's credit card is debited when the order is prepared. Cards from the "CB", Visa, Eurocard/Mastercard network are accepted. In accordance with the French Data Protection Act of 6 January 1978, the customer has the right to access, rectify, and oppose all of their personal data at any time by writing, by mail, and providing proof of identity, to Aaron Kali, 28 Cours Vitton - 69006 Lyon, France.

However, for customers who prefer, payment in installments/deferred payments is available through our partner Alma. Payment security is ensured by Alma and its service providers. All payments are protected by 3D Secure.

To benefit from this financing offer, the following cumulative conditions must be met:

  • the order is placed by an individual, a natural person of legal age residing in France, Belgium, Luxembourg, Italy, Spain, Germany, Portugal, the Netherlands, Austria or Ireland.
  • the financing offer is accepted by alma;
  • the order is between one hundred and forty (140) euros and two thousand five hundred (2,500) euros including all taxes;
  • the order is paid for using a bank card, Visa, Mastercard and American Express issued in the customer's name (excluding prepaid cards, virtual cards, cards without overdraft authorization, systematic authorization cards, cards issued outside the country accepted by Alma), whose expiry date is later than the date of the last installment payment under payment in three (3) or four (4) installments without charge;
  • an initial payment is made on the day of the order. The payment schedule, i.e. the following two or three monthly payments, is made over a period not exceeding three (3) months (or four (4) if the schedule chosen is in 4 interest-free installments) months from the date of purchase.

The customer wishing to benefit from this financing offer must check that he meets the aforementioned conditions and, if so, choose this first option "payment in 3 installments without fees" or this second option "payment in 4 installments without fees" from the payment page of the site.

The customer will be redirected to the Alma website to make the first payment and will be able to view a summary of their order including the amount of the installments and their collection date.

In accordance with article l312-4 5° of the consumer code, the offer of payment in three (3) installments or in four (4) installments without charge is not subject to the provisions of articles l.312-1 of the same code.

Only purchases between €50 and €2,000 are eligible for payment with Alma.
By paying in installments with Alma, the Customer does not pay any fees.

Alma is a telepayment manager and issues an electronic certificate which will serve as proof of the amount and date of the transaction in accordance with the provisions of Articles 1316 et seq. of the Civil Code.

4.3 Refusal of orders

In accordance with the provisions of Article L.122 1 of the Consumer Code, the company Aaron kali will be entitled to refuse any abnormal order or order placed in bad faith, as well as any order from a customer with whom there is a dispute relating to the payment of a previous order.

Article 5: CONDITIONS OF SECURE DELIVERY

Delivery of the items will take place, after payment of the order amount has been recorded, to the customer's address. In accordance with the provisions of Article L.121-20-3 of the French Consumer Code, delivery of the items ordered will take place no later than 30 days from the day following the order, subject to full payment of the price.

Aaron Kali will deliver the ordered items by express transport with STERNE, which has over 30 years of expertise in the delivery of luxury products and valuables.

Any delivery times provided by Aaron Kali are for guidance only. STERNE offers a full range of urgent services, tailored to your specific needs. You can choose delivery within 1, 2, or 4 hours in France, or 24/7 urgent delivery by road or air worldwide.

  • Fast Delivery: This means you can receive your order within 15 days. This option is available upon request at an additional cost.
  • Packages are carefully packaged to ensure their protection during transport.
  • Real-Time Tracking: Once your order has shipped, you will receive a text message with a security code. This will allow you to track the status of your delivery at any time and have visibility on its expected arrival.
  • Hand Delivery: For added peace of mind, we also offer the option of hand delivery. An option available upon request at an additional cost.

Article 6: GUARANTEE

In accordance with the provisions of Articles 1641 et seq. of the Civil Code, Aaron Kali guarantees its products against all defects and hidden defects which would make them unfit for the use for which they are intended, or which would reduce this use so much that the buyer would not have acquired them, or would have paid a lower price for them, if he had known about them.

To benefit from the warranty, the customer must report the hidden defect to Aaron Kali within 10 days of receiving the item. Aaron Kali reserves the right to have the product examined by our workshop.

Your Aaron Kali Jewel is guaranteed for 1 year against any manufacturing defect from the date of purchase, subject to acceptance of the support by the expertise of our customer service.

Gold chains, pendants or pieces that have been broken due to improper use are not covered by the warranty.
However, it will be possible, after examination by our experts, to have it repaired in our workshops at your expense. (Quote in advance)

Article 7: Satisfied or refunded - right of withdrawal and return of items

 

Aaron Kali intends that those of its customers who are not satisfied with the items ordered may exercise the right of withdrawal provided for by article L.121-1 of the Consumer Code under the following conditions:

7.1 Non-personalized items : From receipt of the goods, the customer has 14 days to withdraw. Before the expiry of this period, the customer must send a declaration of withdrawal by mail or email.

From then on, the customer must return the items within 14 days following the date of withdrawal, in their original packaging, in their original condition (new), complete (accessories, instructions, etc.), accompanied by the return slip (provided by a simple email), to the following address:

It will be up to the customer to provide proof of this return, which means that the items must be returned by registered mail, or by any other means providing a certain date, with the costs and risks of return remaining the responsibility of the customer.

In case of refund agreement, the refund will be made within 15 days from receipt of the returned products. The refund will be made by the same means of payment that the customer used to pay for their order.

Reimbursement of returned items at the invoiced price will be made, depending on the method of payment for the items, by credit to the customer's bank account corresponding to the bank card used for payment, within thirty days of receipt.

The exchange of items cannot be made in store or with one of the brand's distributors.

It is specified that within the framework of the use of the Gift Service, the right of withdrawal remains for the exclusive benefit of the customer and cannot under any circumstances be exercised by the recipient of the gift.

Items returned incomplete, damaged, spoiled, deteriorated or soiled by the customer will not be refunded.

7.2 Personalized items : According to article L.221-28-3 “The right of withdrawal cannot be exercised for contracts for the supply of goods made according to the consumer’s specifications or clearly personalized”.

If you wish to cancel your order, you must contact our customer service at sav@aaronkali.com or by phone at 09 85 02 63 27 to ensure that your order has not yet been prepared, as all orders are processed the same day or the following business day.
If you place your order before 1 p.m. on a weekday, we will endeavor to prepare your product(s) in the afternoon of the same day. If you place your order after 8 p.m. or on a Saturday/Sunday/public holiday, your order will be released in the morning of the following business day.
If your order has already been prepared, you unfortunately cannot cancel it.

Article 9: Electronic files - protection of personal data

Aaron Kali has created an electronic file that records certain personal data relating to its customers. When a new customer places an order online on the website www.aaronkali.com, this database will be enriched with information about them, which will subsequently allow us to better meet their expectations and facilitate the support services provided by the E-commerce service. This database has been declared, in accordance with the requirements of the "Informatique et Libertés" law n°78-17 of January 6, 1978, amended by law n°2004-801 of August 6, 2004.

In the event that the customer consents to communicate individual data of a personal nature, he/she would then have the individual right of access, withdrawal and rectification provided for by law and may in this regard have information concerning him/her deleted which is no longer relevant, by making a written request to the company Aaron Kali, at the address mentioned in the previous article.

Depending on the choices made when creating or consulting their online accounts, customers may choose whether they wish to receive offers from Aaron Kali, or be informed of specific operations via email. If a customer no longer wishes to receive these offers, they can request this at any time by clicking on an electronic link available in emails for this purpose, or by modifying their account directly on the website www.aaronkali.com.

Article 10: Intellectual Property Rights

The Aaron Kali brand, as well as all figurative or non-figurative trademarks and more generally all other trademarks, illustrations, images and logos appearing on Aaron Kali items, their accessories or their packaging, whether registered or not, are and will remain the exclusive property of the company Aaron Kali. Any total or partial reproduction, modification or use of these trademarks, illustrations, images and logos, for any reason and on any medium whatsoever, without the express prior consent of the company Aaron Kali, is strictly prohibited. The same applies to any combination or conjunction with any other brand, symbol, logo and more generally any distinctive sign intended to form a composite logo. The same applies to all copyrights, designs and models, patents which are the property of the company Aaron Kali.

Article 11: Force majeure

The performance by Aaron Kali of all or part of its obligations shall be suspended in the event of the occurrence of a fortuitous event or force majeure which hinders or delays its performance. Such events include, but are not limited to, war, riots, insurrection, social unrest, strikes of any kind and supply problems for Aaron Kali.

Aaron Kali will inform the customer of any such unforeseeable event or force majeure within seven days of its occurrence. In the event that this suspension continues beyond a period of fifteen days, the customer will then have the option of canceling the current order, and the customer will then be reimbursed under the conditions set out in Article 7 of these general terms and conditions of sale.

Article 12: Disputes - applicable law

These general conditions of sale are governed by and interpreted in accordance with French law.

In the event of a dispute, litigation, controversy or claim arising out of or relating to the terms of sale, the customer is invited to contact Aaron Kali customer service (see contact details in article 8).

In the absence of amicable solutions or recourse to mediation, all disputes to which the general conditions of sale may give rise will be submitted to the competent courts in accordance with the rules of common law.
